Terms of Service

Welcome to Request For Talent ("RFT," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our platform, which connects independent consultants with companies in real estate development, architecture, and construction. By accessing or using RFT, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use RFT.

2. Eligibility

To use RFT, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using our services under applicable law
  • For company accounts: Use a valid business email address (personal email domains such as Gmail, Yahoo, Outlook, Hotmail, iCloud, and AOL are not permitted)

3. Account Registration

You must register for an account to access certain features of RFT. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. User Types & Roles

Consultants: Independent professionals who create profiles showcasing their expertise, portfolio, and services. Consultants can browse RFT postings, apply for opportunities, and receive invitations from companies.

Companies: Organizations seeking to engage consultants for short-term contract work. Companies can post RFTs (Request For Talent), search for consultants, and invite candidates to apply.

5. Platform Rules

When using RFT, you agree not to:

  • Provide false or misleading information in your profile or postings
  • Impersonate another person or entity
  • Use the platform for any unlawful purpose
  • Harass, abuse, or harm other users
  • Circumvent the platform to avoid fees or payment obligations
  • Scrape, harvest, or collect user information without consent
  • Interfere with the platform's security or proper functioning
  • Post spam, promotional content, or unrelated material
  • Share your account credentials with others

6. RFT Postings

Companies posting RFTs agree to:

  • Provide accurate descriptions of the opportunity
  • Include truthful information about compensation, duration, and requirements
  • Respond to applications in a timely and professional manner
  • Not post discriminatory or illegal content

RFT postings expire 30 days from creation and may be renewed, edited, or closed at any time by the posting company.

7. Applications & Engagement

RFT facilitates introductions between consultants and companies. Any engagement, contract, or employment relationship formed through our platform is solely between the consultant and the company. RFT is not a party to such agreements and is not responsible for:

  • Payment disputes between users
  • Quality of work or services provided
  • Performance of contractual obligations
  • Tax, insurance, or legal compliance

8. Intellectual Property

Our Content: The RFT platform, including its design, features, and functionality, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

Your Content: You retain ownership of content you post on RFT. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating and promoting the platform.

9. Privacy

Your use of RFT is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using RFT, you consent to our collection and use of data as described in the Privacy Policy.

10. Disclaimer of Warranties

RFT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT VERIFY THE QUALIFICATIONS, CREDENTIALS, OR BACKGROUND OF USERS AND MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF ANY CONSULTANT OR OPPORTUNITY.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RFT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless RFT and its affiliates from any claims, damages, losses, or expenses arising out of your use of the platform, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may close your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately, but these Terms will continue to apply to your past use.

14. Modifications to Terms

We may revise these Terms at any time by posting an updated version on this page. Changes are effective when posted. Your continued use of RFT after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of RFT shall be resolved in the state or federal courts located in San Francisco, California.
